Preliminary Provisions

The BBQ.pl online store, available at the BBQ.pl internet address, is run by TENDER MEAT spółka z ograniczoną odpowiedzialnością with its registered office in Płońsk, registered in the District Court for the capital city of Warsaw, 14th Commercial Division of the National Court Register under KRS number 0000114381, share capital PLN 54,000, NIP 5671640019, REGON 130448458

These regulations are addressed to Consumers and define the rules and procedure for concluding a Distance Sales Agreement with the Consumer via the Store.

Definitions

Seller - TENDER MEAT limited liability company with its registered office in Płońsk, registered in the District Court for the Capital City of Warsaw, 14th Commercial Division of the National Court Register under KRS number 0000114381, share capital PLN 54,000, NIP 5671640019, REGON 130448458

Entrepreneur - a natural person, a legal person and an organizational unit that is not a legal person, to which a separate act grants legal capacity, conducting business activity on its own behalf, which uses the Store.

Store - an online store run by the Seller at the Internet address BBQ.pl

Distance contract - a contract concluded with the Customer as part of an organized system for concluding distance contracts (as part of the Store), without the simultaneous physical presence of the parties, with the sole use of one or more means of distance communication up to and including the moment of conclusion of the contract.

Regulations - these Regulations of the Store.

Order - Customer's declaration of intent submitted via the Order Form and aimed directly at concluding a Product or Products Sales Agreement with the Seller.

Account - the customer's account in the Store, it collects data provided by the Customer and information about Orders placed by him in the Store.

Registration form - a form available in the Store that allows you to create an Account.

Order form - an interactive form available in the Store that allows you to place an Order, in particular by adding Products to the Basket and specifying the terms of the Sales Agreement, including the method of delivery and payment.

Cart - an element of the Store's software, in which the Products selected by the Customer for purchase are visible, and it is also possible to determine and modify the Order data, in particular the quantity of products.

Product - a movable item/service available in the Store, which is the subject of the Sales Agreement between the Customer and the Seller.

Sales Agreement - a Product sales agreement concluded or concluded between the Customer and the Seller via the Online Store.

The Customer may communicate with the Seller using the addresses and telephone numbers provided in this paragraph.

The Customer may communicate with the Seller by phone between 8:00 and 16:00 at the telephone number +48 23 662 69 20.

Technical requirements

To use the Store, including browsing the Store's assortment and placing orders for Products, the following are necessary:

  • end device with access to the Internet
  • having a web browser
  • cookies enabled
  • having a mobile phone number

General information

The Seller, to the fullest extent permitted by law, is not responsible for disruptions, including interruptions in the functioning of the Store, caused by force majeure, unauthorized actions of third parties or incompatibility of the Online Store with the Customer's technical infrastructure.

Browsing the Store's assortment does not require creating an Account. Placing orders by the Customer for Products in the Store's assortment is possible either after creating an Account or by providing the necessary personal and address data enabling the execution of the Order without creating an Account.

The prices given in the Store are given in Polish zlotys and are gross prices (including VAT).

Setting up an account in the store

To set up an Account in the Store, you must complete the Registration Form. It is necessary to provide the following data:

  • e-mail address
  • the password must contain at least six (6) characters: uppercase and lowercase letters and a minimum of one special character
  • first name and last name
  • address of residence (street, block number, apartment number, city, postal code)
  • Phone number
  • delivery address - if different from the address of residence

Setting up an Account in the Store is free. Logging into the Account is done by entering the login and password set in the Registration Form. You can also log in with your Google or Facebook account.

The Customer may at any time, without giving a reason and without incurring any fees, delete the Account by sending an appropriate request to the Seller, in particular via e-mail or in writing.

Rules for placing an order

In order to place an Order, you must:

  • log in to the Store (optional)
  • select the Product being the subject of the Order, and then click the "Add to Cart" button
  • log in or use the option of placing an Order without registration
  • if the option of placing an Order without registration has been selected - fill in the Order Form by entering the details of the recipient of the Order and the address to which the Product is to be delivered, select the type of shipment (method of delivery of the Product);
  • click the "Order and pay" button and confirm the order by clicking on the link sent in the e-mail
  • choose one of the available payment methods and, depending on the payment method, pay for the order.

Delivery and payment methods offered

The Customer may use the following methods of delivery of the ordered Product:

DPD or DPD Food courier delivery.

The customer can use the following payment methods:

  • payment by bank transfer to the Seller's account
  • PayU and Przelewy24 electronic payments
  • payment by credit card. The operator of Przelewy24 payment cards is PayPro SA Agent Rozliczeń, ul. Kanclerska 15, 60-327 Poznań, entered into the Register of Entrepreneurs of the National Court Register kept by the District Court for Poznań - Nowe Miasto and Wilda in Poznań, 8th Commercial Division of the National Court Register under the number KRS 0000347935, NIP 7792369887, Regon 301345068.

Execution of the sales contract

The conclusion of the Sales Agreement between the Customer and the Seller takes place after the Customer has placed an Order using the Order Form in the Online Store and made the payment.

After placing the Order and receiving the payment, the Seller immediately executes the Order. Confirmation of receipt of the Order and its acceptance for implementation takes place by sending the appropriate e-mail to the Customer by the Seller to the Customer's e-mail address provided when placing the Order, which contains at least the Seller's statement on receipt of the Order and its acceptance for implementation and confirmation of the conclusion of the Sales Agreement. Upon confirmation of receipt by the Customer of the above e-mail, a Sales Agreement is concluded between the Customer and the Seller.

The product will be sent by the Seller on the date indicated in its description, in the manner chosen by the Customer when placing the Order.

In the case of ordering Products with different delivery dates, the delivery date is the longest given date.

In the case of ordering Products with different delivery dates, the Customer has the option of requesting delivery of the Products in parts or delivery of all Products after completing the entire order.

The beginning of the period of delivery of the Product to the Customer is counted from the date of crediting the Seller's bank account.

The delivery of the Product takes place in Poland.

Delivery of the Product to the Customer is payable, unless the Sales Agreement provides otherwise. Product delivery costs (including charges for transport, delivery and postal services) are indicated to the Customer when placing the Order, including when the Customer expresses his will to be bound by the Sales Agreement.

Right of withdrawal

The consumer purchasing products at BBQ.pl has a limited right to withdraw from the contract, which is caused primarily by the fact that the vast majority of products prepared by BBQ.pl ordered on the Website are prepared according to the individual needs of the customer, moreover, these products have a short shelf life and which, after opening the packaging, cannot be returned due to health protection or hygiene reasons, if the packaging has been opened after delivery.

According to Art. 38 of the Act of 30 April 2014 on Consumer Rights (Journal of Laws of 2014, item 827), the right to withdraw from a distance contract is not entitled to the Consumer, e.g. in relation to contracts:

  • in which the subject of the service is a non-prefabricated item, manufactured according to the Consumer's specifications or serving to satisfy his individual needs
  • in which the subject of the service is an item that deteriorates quickly or has a short shelf life
  • in which the subject of the service is an item delivered in a sealed package, which cannot be returned after opening the package due to health protection or hygiene reasons, if the package was opened after delivery

Complaint and warranty

The Seller is obliged to provide the Consumer with an item free from defects.

BBQ.pl is liable to the Consumer for product defects on the terms set out in the provisions of the Act of 23 April 1964. Civil Code (consolidated text, Journal of Laws of 2014, item 121, as amended).

The complaint must be submitted by the Consumer electronically to the Seller's e-mail address: sklep@bbq.pl. Due to the nature of the product and the need for its proper storage, all claims and complaints must be reported within 24 hours of receiving the shipment. Claimed products must remain in their original packaging. Until the complaint is considered, they must be stored in appropriate refrigeration conditions (products cooled in a refrigeration device, frozen products in a freezer).

Obvious technical damage to the packaging caused during transport must be immediately reported to the carrier delivering the shipment, as well as documented photographically or in the form of video during the receipt of the shipment.

In order to submit a complaint related to a product defect, the Consumer must make a video or photographic documentation of the advertised product, placing the product label on the recording or photo and visible, reported product defects. Then he must send this documentation together with a concise description of the product defect to sklep@bbq.pl within 24 hours of receiving the shipment. It is recommended that the complaint also include the data of the Consumer submitting the complaint and the Consumer's request in connection with the defect of the goods.

The claimed goods must be left in their original packaging and stored in refrigerated conditions at the Seller's disposal.

The seller will respond to the complaint request immediately, no later than within 7 days. If the Seller does not respond to the complaint request within 7 days, it is considered that the Consumer's request was justified.

If the Seller finds the complaint justified, the products will be immediately replaced and delivered to the Consumer.

The consumer is obliged to return the claimed goods on the next working day after accepting the complaint at the Seller's expense to the Seller's address in a protective packaging (styrobox and cooling inserts). The consumer may also agree with the Seller that the Seller will collect the goods from him using his own refrigerated transport.

Complaints submitted within a period other than 24 hours from the time of receipt of the parcel, unfortunately, will not be considered.

Methods of dealing with complaints

Detailed information on the possibility for the Consumer to use out-of-court methods of dealing with complaints and pursuing claims as well as the rules of access to these procedures are available at the offices and on the websites of poviat (municipal) consumer ombudsmen, social organizations whose statutory tasks include consumer protection, Voivodship Inspectorates of the Inspection Handlowa and at the following Internet addresses of the Office of Competition and Consumer Protection: http://www.uokik.gov.pl/spory_konsumenckie.php; http://www.uokik.gov.pl/sprawy_indywidualne.php and http://www.uokik.gov.pl/wazne_adresy.php.

The consumer has the following exemplary possibilities of using out-of-court methods of dealing with complaints and pursuing claims:

The consumer is entitled to apply to the permanent amicable consumer court referred to in art. 37 of the Act of December 15, 2000 on the Trade Inspection (Journal of Laws of 2014, item 148, as amended), with a request to settle a dispute arising from the Agreement concluded with the Seller.

The consumer is entitled to apply to the provincial inspector of the Trade Inspection, in accordance with art. 36 of the Act of 15 December 2000 on the Trade Inspection (Journal of Laws of 2014, item 148, as amended), with a request to initiate mediation proceedings regarding the amicable settlement of the dispute between the Consumer and the Seller.

The consumer may obtain free assistance in resolving the dispute between him and the Seller, also using the free assistance of the poviat (municipal) consumer ombudsman or social organization whose statutory tasks include consumer protection (including the Consumer Federation, Association of Polish Consumers).

Personal data in the BBQ.PL online store

The administrator of Customers' personal data collected via the Online Store is the Seller.

Customers' personal data collected by the administrator via the Online Store are collected in order to implement the Sales Agreement, and if the Customer agrees - also for marketing purposes.

The recipients of the personal data of the Online Store Customers may be:

  • In the case of a Customer who uses the Online Store with the method of delivery by post or courier, the Administrator provides the collected personal data of the Customer to the selected carrier or intermediary performing the shipment at the request of the Administrator.
  • In the case of a Customer who uses electronic payments or a payment card in the Online Store, the Administrator provides the Customer's collected personal data to the selected entity servicing the above payments in the Online Store.

The customer has the right to access their data and correct them.

Providing personal data is voluntary, but failure to provide the personal data indicated in the Regulations necessary to conclude the Sales Agreement results in the inability to conclude this contract.

Final Provisions

Agreements concluded through the Online Store are concluded in Polish.

The Seller reserves the right to amend the Regulations for important reasons, that is: changes in the law, changes in payment and delivery methods - to the extent that these changes affect the implementation of the provisions of these Regulations.

In matters not covered by these Regulations, generally applicable provisions of Polish law shall apply, in particular: the Civil Code; the act on the provision of electronic services; the act on consumer rights, the act on the protection of personal data.

The customer has the right to use extrajudicial means of dealing with complaints and pursuing claims. For this purpose, he may submit a complaint via the EU ODR online platform available at: http://ec.europa.eu/consumers/odr/.
